It is unclear whether the Biden Administration will grant head of State immunity to Kagame in Mr. Paul Rusesabagina case. If the Biden administration does not grant immunity to Kagame, Kagame will have to appear before the Washington court. It will likely be one of the most expensive litigations in the world.
The only way Kagame can survive this litigation is by asking for immunity from President Biden. If the Biden Administration grants him immunity, Kagame will be off the hook, for now.
When the Biden administration ordered Kagame to release Mr. Paul Rusesabagina, Kagame said that he cannot interfere with “courts” in Rwanda. Will Biden say the same to Kagame when Kagame’s lawyers apply for head of State immunity for Kagame?
President Obama granted head of State immunity to Kagame in President Habyarimana case. President Habyarimana’s family filed a civil case against Kagame in the U.S.A. If the Biden Administration does not grant immunity to Kagame in Mr. Paul Rusesabagina case, President Habyarimana’s family will certainly pursue their case against Kagame. President Habyarima’s case is around $400 million, too.
If the Biden Administration does not grant ‘head of state immunity’ in Paul Rusesabagina case, other Rwandan families in the US, including Col. Patrick Karegeya’s family, will likely file cases against Kagame in the US. Will President Biden save Kagame?
What if the Biden Administration grants head of state immunity to Kagame in Rusesabagina case, the same way the Obama Administration granted Immunity to Kagame in President Habyarimana case? Well, all cases will be shelved until Kagame is out of office.
